What Is ITAR, and When Does It Apply?
Understand defense trade controls, regulated activities, and why registration is not export authorization.
Export controls require a factual analysis
The International Traffic in Arms Regulations govern specified defense articles, services, and technical data. Applicability depends on jurisdiction, classification, activities, parties, and exemptions, not merely whether your customer works in defense.
Domestic activities can also create registration or other obligations. Do not assume no international shipment means no ITAR issue.
Review before sharing or performing
- 01Determine whether the item, service, or data falls under the relevant controls.
- 02Review activities such as manufacturing, exporting, brokering, or providing defense services.
- 03Identify registration, authorization, recordkeeping, and access requirements.
- 04Check destinations, people, transfers, and applicable exemptions.
- 05Obtain qualified export-control advice where the analysis is uncertain.
Registration is not permission to export
The regulation states that registration does not confer export rights or privileges. A registered company still needs to determine what authorizations or exemptions support the particular activity.
Build operating controls
Protect technical data, train relevant people, review third-party access, and maintain records. A marketing statement of ITAR compliance is not a substitute for an actual program. This overview does not determine jurisdiction or authorize any transaction.
Official sources
Check current instructions and requirements directly with the relevant agency.
